By visiting and using Pureprofile, you are accepting the practices outlines in this policy.
1.1 What these terms cover. These terms govern your access to and use of Pureprofile’s website, applications, products, and services – we refer to these as “Pureprofile products” in these terms – when you register to join the Pureprofile community.
1.2 Why you should read them. Please read these terms carefully before you apply to join the Pureprofile community. These terms tell you who we are, how we will provide Pureprofile products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
2.1 Who we are. We are Pureprofile UK Limited, a company registered in England and Wales. Our company registration number is 04077299 and our registered office is at 3B Zetland House, 5-25 Scrutton Street, London EC2A 4HJ. Our registered VAT number GB 815 0646 45.
2.2 How to contact us. You can contact us by telephoning our service team at +44 20 3947 8500 or by writing to us at consumercare@pureprofile.com or Pureprofile UK Limited, 3B Zetland House, 5-25 Scrutton Street, London EC2A 4HJ. Alternatively, you can complete and submit an online enquiry at www.pureprofile.com/contact-us/.
2.3 How we may contact you. If we have to contact you we will do so by writing to you at the email address you provided to us when you registered with us. We may also contact you without offering a reward by sending you a newsletter.
2.4 Why we may contact you. We may contact you to make verifications of your account and profile information, for customer service issues, for feed activity invitations, and to confirm your Pureprofile account activity. We may also contact you on third party websites through targeted advertising, using the anonymised details you provide. You can set preferences in relation to the communications you receive from us when you are logged into a Pureprofile product, such as the website or application.
2.5 “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
3.1 How to register. To access and use a Pureprofile product, you must register your Pureprofile account by entering a valid email address and creating a password in the registration section of the Pureprofile website or application. You will also be asked to accept these terms as part of the process.
3.2 Linking your personal social media accounts. Linking your social media accounts (such as Facebook, Twitter or LinkedIn) is completely up to you and not a requirement of registration. You may also choose to link your social media accounts at a later time.
3.3 Keep your password confidential. You are entirely responsible for all activities and transactions made from your account. For this reason, it is your responsibility to keep your password confidential. We are not liable for any loss or damage from any unauthorised use of your account.
3.4 Notify us immediately of any unauthorised account use. If you become aware of any unauthorised use of your account or any other security breach relating to you and a Pureprofile product, please contact us immediately through our Contact Us page.
3.5 Only one account. You may only register one Pureprofile account. If you attempt to register multiple accounts, we have the right to suspend or close any and all of these accounts without notice and to ban you from using Pureprofile products. If we close your account(s) because you have opened multiple accounts, you forfeit all rewards that you have earned.
3.6 We only accept registrations from those resident in the UK, Germany, Belgium or the Netherlands. We only make Pureprofile products available to those resident in the UK, Germany, Belgium or the Netherlands. Unfortunately, we do not accept applications to register from those who do not meet these residence requirements.
3.7 We choose if you can be or remain an account holder. We will always seek to act fairly but the refusal of an account registration and/or account closure is at our discretion.
4.1 Online profiles. When you register, you’ll be given the opportunity to create an online profile by answering a set of questions. We will repeat these questions at regular intervals to ensure your profile is always up to date. If you wish to update, change or delete profile information at any time you can contact us and we will take the appropriate action.
4.2 How we use profile information. We use profile information to publish and deliver “Insights” tailored to you, your interests and hobbies. We use profile information in conjunction with information obtained from other sources such as web cookies, your IP address and geolocation software to match and deliver relevant activities to you through Pureprofile products.
4.3 We don’t disclose profile information. We do not disclose information provided by you while using Pureprofile products to any business in a format that may allow you to be personally identified. We may aggregate profile information with other members’ profile information and allow businesses to access this grouped and anonymous information.
5.1 What are “Insights”? We produce “Insights” from de-identified data we have collected from your and other members’ responses to profile questions. We may launch or withdraw Insights at any time, without notice from us, on Pureprofile products or other media (like our social media platforms).
5.2 What you can do with “Insights”. You may share or re-publish our “Insights”, but only for non-commercial use. You need prior written consent to use “Insights” for the following purposes:
(a) educational or research purposes; and
(b) commercial use.
5.3 Restrictions on sharing/re-publishing “Insights”. When you share or re-publish an “Insight” with a non-commercial purpose, in any media, you agree that:
(a) you will not misrepresent the information contained in the “Insight”;
(b) you will not share and/or publish the “Insight” in any way that would bring us or Pureprofile products into disrepute;
(c) you will not share and/or re-publish the “Insight” on websites that:
(i) contain unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane, indecent information or material; or
(ii) promote, provide or offer unsuitable or inappropriate products or services, including but not limited to gambling, adult services and erotic products; and
(d) you will not share and/or re-publish the insight by using “spam” or “spamming techniques”.
5.4 Intellectual Property Rights in “Insights”. All intellectual property rights in “Insights” belong to us or our licensors. If you own any intellectual property rights in content in an “Insight”, you agree that in consideration for us granting you the right to use that “Insight” as provided for in this paragraph 5, you grant us a perpetual, irrevocable, royalty-free, transferable right and licence to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute your content and/or incorporate your content into any form, medium or technology throughout the world without compensation to you.
6.1 Invitations to feed activities. You may receive invitations to various activities in your Pureprofile feed. You may either accept or skip them. If you accept an activity, you will be taken to a starting page. If you skip it, you will be shown the next available activity in your feed.
6.2 More about activities. Unless the activity expressly indicates otherwise, the content of an activity does not originate from us, and the inclusion of any particular content does not constitute a recommendation or endorsement of that content by us, our directors or employees. We make no express or implied guarantee or warranty about the nature, suitability or authenticity of activity content, or any offer contained in an activity.
6.3 No guarantee of number of activities. We make no express or implied guarantee or warranty about the number of activities you will be invited to participate in.
6.4 Offers in activities. Any offer contained in an activity is made by the business identified in that activity, and not us. The business making the offer is solely responsible for both the accuracy of the offer and the fulfilment of any obligations attached to the offer.
6.5 Activity liabilities. We are not liable for any damage or loss caused by activities or the acceptance of any offer contained in an activity.
7.1 Data quality controls. To ensure we access high quality data, we have put in place a number of quality control measures to ensure response data meets and exceeds industry standards and best practice. For each activity we conduct, we undertake the following data quality checks:
(a) all open ended answers are checked for:
(i) offensive or inappropriate language; and
(ii) incomprehensible free text responses such as ‘qwfqwfqwf’;
(b) the time taken for you to complete the activity will be checked against the estimated completion time for that activity; and
(c) all responses will be checked for inconsistent or inaccurate answers, which can include (but are not limited to):
(i) responses which contradict other responses you have submitted during an activity;
(ii) responses which contradict information in your profile;
(iii) responses which fail logic or trick testing within an activity;
(iv) selecting all answers in a multi-response question to qualify for an activity; and
(v) for grid style questions, selecting all answers in a column or row, or selecting answers in a diagonal pattern.
7.2 Your responsibilities when providing information or completing an activity. You must not provide information in your profile that is, or responses in any activity that are:
(a) offensive, obscene or inappropriate;
(b) incomprehensible;
(c) defamatory or break any contract or law or break any duty of confidentiality, infringe any copyright or data protection rights, or constitute contempt of court;
(d) cause injury to any person or entity;
(e) false, inaccurate or misleading;
(f) hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
(g) anything for which you were compensated or granted any consideration by any third party;
(h) rushed or ill-thought out;
(i) inconsistent and/or inaccurate; or
(j) in a language other than English.
7.3 Failure to comply with this paragraph 7. If we reasonably consider or determine you have not complied with this paragraph 7, we may:
(a) deduct any reward you received for any related activity from your Pureprofile account balance;
(b) block you from receiving further activities;
(c) prevent you from using Pureprofile products; and/or
(d) close your Pureprofile account.
8.1 How to earn rewards. You can earn rewards by participating in Pureprofile activities like surveys, website visits, video posts, and much more. To become entitled for a reward when participating in an activity;
(a) the information in your profile must match the targeting criteria for the activity;
(b) the end date for the activity must not have passed; and
(c) you must:
(i) view and accept the invitation for the activity;
(ii) answer all questions asked; and
(iii) reach the final page at the conclusion of the activity and follow any instructions on that page.
8.2 Late activity invitations. Neither we nor the business identified in the activity will be liable to you for any loss or damage arising from or connected with you receiving an invitation or activity after the end date for that activity.
8.3 Fulfilment of activity offers. If a business defaults on its obligation to fulfil an offer, we are not responsible for or liable to fulfil that offer and are not liable for any loss or damage that results from the business not satisfying its reward offer.
8.4 Recordkeeping and account balances. We store a record of any rewards you earn through interaction with Pureprofile products. We may debit or credit your Pureprofile account balance at any time and without notice, to rectify any payments made to, or debits from, your account balance which were caused by human error, technological error or any other mistake or systems failure.
8.5 Inactive Pureprofile accounts. If your Pureprofile account is inactive for twelve months or more, we may cancel any rewards in your account balance.
8.6 Disputes and complaints. If you wish to dispute a reward or have a complaint about a reward, please refer to paragraph 15.1.
9.1 How to redeem rewards. You may redeem rewards earned through your use of Pureprofile products using the redemption methods we make available from time to time. We may add or cease redemption methods at any time so please ensure you follow the correct procedures in place at the time you request a redemption.
9.2 Minimum balances. Certain redemption methods may require you to have a minimum reward balance before you can redeem or only allow you to redeem up to a certain amount within a specified time period. These restrictions are set by us and may be amended from time to time.
9.3 Bank / PayPal redemptions. If you make a redemption for payment to a bank or PayPal account, it may take up to 30 business days for the payment to be processed. We can only make payment into a bank / PayPal account under your own name or a joint bank account which identifies you as a joint account holder.
9.4 Your responsibility to provide the correct details. If a redemption requires us to transfer your redeemed reward to an account or an email address (for example, payment into a bank account or sending a voucher code to an email address), you are responsible for providing us with correct account or email address details. The information you enter is used to automatically transfer the reward to the account for which you provided the details. We cannot recall completed redemptions so, if you provide incorrect account details, we may not be able to recover the redemptions made.
9.5 We are not responsible if you provide the wrong information or third party errors. We are not responsible or liable for any loss or damage suffered or incurred by you which is caused by a transfer of rewards made in accordance with your instructions. You are liable for any costs associated with the provision of incorrect or incomplete details in your redemption request. We are not liable for errors made by third parties in relation to your redemption request.
9.7 Tax is your responsibility. You are responsible for identifying any potential tax liabilities that may arise through your use of Pureprofile products. We make Pureprofile products available to you as a consumer and not as a business.
10.1 No unlawful or illegal conduct. You must not use Pureprofile products for any purpose that is unlawful, or prohibited by these terms or any other terms, conditions or notices appearing anywhere within Pureprofile products. Particularly, you must not:
(a) copy material that is made available by third parties on or through Pureprofile products or reproduce or publish such materials;
(b) use, post or transmit any:
(i) unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane or indecent information, language or material;
(ii) communication that may either constitute or encourage conduct that is a criminal offence or may give rise to civil liability, or otherwise violate any applicable law;
(iii) information or material which damages our reputation or the reputation of any business, or which we consider as likely to damage our reputation or the reputation of any business;
(iv) material which violates or infringes the rights of any person, including but not limited to the rights of privacy, copyright, trade marks, patents, confidentiality and any other intellectual property, personal or proprietary rights;
(v) material of any kind which contains or elicits a computer or software corruption, virus or other harmful component; or
(vi) communication that contains promotional or advertising material;
(c) impersonate any person or entity;
(d) exploit any material on or within a Pureprofile product for a commercial purpose;
(e) use Pureprofile products to send spam; or
(f) use Pureprofile products to send to engage in any other forms of internet abuse, including:
(i) tampering, hacking, spoofing or using robots or scripts; or
(ii) copying, distributing, modifying or otherwise interfering with the administration, security or proper and intended function of any part of Pureprofile products.
10.2 Consequences for non-compliance. If you are found to have not complied with paragraph 10.1, we may close your Pureprofile account and bring civil proceedings against you for any damage, loss or expense directly or indirectly caused by your actions. If you have committed a criminal offence, you may be prosecuted. Whilst we are not obliged to supervise your use of Pureprofile products, we reserve the right to monitor Pureprofile products and retain and disclose all information necessary to satisfy any applicable law, regulation, legal process or government request.
11.1 When you can make referrals. You may invite a friend to register a Pureprofile account once you meet the eligibility criteria to refer. These are:
(a) you have verified your email address;
(b) you have completed the first activity in your personal feed; and
(c) you have started ANY other activity in the past 30 days.
11.2 Compliance with referral rules. You must comply with any referral rules and regulations which we may introduce from time to time. If rewards are available, you will only be able to earn the reward where you have complied with the relevant rules and regulations.
11.3 Incentives and referrals. We may offer incentives for referring a friend to register a Pureprofile account. We will only honour rewards relating to referrals if:
(a) the person you invite registers an account before the incentive offer expires;
(b) the invitation email, link or message was in the form specified by us;
(c) you comply with the rules and conditions of any websites to which invitations may be sent via a Pureprofile product; and
(d) the person you invite is eligible to register for a Pureprofile account.
11.4 Restrictions on referrals. You must not invite people to register Pureprofile accounts by:
(a) using spam or spamming techniques;
(b) misrepresenting the amount of money they may earn by using Pureprofile products; or
(c) displaying invitation links or messages on websites that:
(i) contain unlawful, threatening, abusive, defamatory, obscene, vulgar, pornographic, profane, indecent information or material; or
(ii) promote, provide or offer unsuitable or inappropriate products or services, including but not limited to gambling, adult services and erotic products.
12.1 When and how you can close your account. You may close your Pureprofile account at any time. To close your account visit the “Close My Account” section in the “Settings” section in your account. If you have any problems, please do contact us – see paragraph 2.2. You’re responsible for redeeming any rewards that you have earned before you close your account. You can only redeem rewards in accordance with our redemption rules. This means that if you do not have the minimum redemption amount in your Pureprofile account, you will not be able to redeem existing rewards.
12.2 When we can close your account. We may, without notice, refuse your application to register a Pureprofile account or may close your Pureprofile account if you:
(a) breach any part of these terms;
(b) send spam messages through Pureprofile products; or
(c) act against our business interests or reputation.
Your account will be closed without further formality if we cease to operate as a business.
12.3 Inactive accounts. We may determine that you are an inactive member if you haven’t engaged in an activity in over 12 months. If this is the case, we reserve the right to suspend and/or close your account if you do not respond to our messages requesting that you reactivate your account. If your account is suspended, we may request documentary evidence or other proof of your identity in order to confirm the authenticity of your account. If you fail to respond to our request or provide adequate proof, we may close your account.
12.4 Loss of a loved one. If you wish to close an account on behalf of a deceased member, please contact us – see paragraph 2.2. Please do not be offended but we will ask you to provide some form of evidence to show you have the right to request the closure of the deceased’s account.
12.5 What happens if your account is closed. If your Pureprofile account is closed for any reason (and whether by you or us), you’ll forfeit all rewards which you may have entitled to and all profile information provided by you through Pureprofile products will be deleted from our records, except where we are required to retain such information by law.
13.1 We may make changes to Pureprofile products. We may change Pureprofile products for a number of reasons, including:
(a) to reflect changes in relevant laws and regulatory requirements;
(b) to implement technical adjustments and improvements, for example to address a security threat; and
(c) to reflect the demands / needs of members of the Pureprofile community or our business.
14.1 How to tell us about problems. If you have any questions or complaints about a Pureprofile product, please contact us. You can telephone our service team at +44 20 3947 8500 or write to us at consumercare@pureprofile.com or Pureprofile UK Limited, 3B Zetland House, 5-25 Scrutton Street, London EC2A 4HJ. Alternatively, you can complete and submit an online enquiry at www.pureprofile.com/contact-us/. We will endeavour to answer your questions and resolve any complaints as quickly as possible, though this may take up to two weeks.
15.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen. To be clear, we are not liable for any loss or damage that results from: (a) unauthorised access or alterations made to your communications, transmissions or profile information; or (b) statements or conduct of any third party on or within Pureprofile products.
15.2 We are not responsible for information, products or service received through Pureprofile products. Unless we tell you that we are making the offer, any offer for information, products or services you may receive through Pureprofile products or any activities is not an offer made by us. We make no warranties or representations of any kind in relation to, and are not responsible for the accuracy, completeness, authenticity, reliability or suitability of any information contained in an activity or Pureprofile products. It is the responsibility of the business offering the information, product or service to ensure its accuracy, completeness, authenticity, reliability or suitability. We are not liable for any loss or damage that results from your, or anybody else’s, reliance on the information, products or services provided or promoted by a business or any other person. By making information, products or services accessible through Pureprofile products, we are not soliciting any person to use such information, products or services in jurisdictions where that use would be illegal.
15.3 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; or, for breach of your legal rights in relation to Pureprofile products.
15.4 When we are liable for damage to your property. If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
15.5 We are not liable for business losses. We only supply Pureprofile products for personal use. If you use Pureprofile products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
15.6 Links to third party sites. We have no control over the content on websites hyperlinked from Pureprofile products. We make no express or implied warranties in relation to the content of these sites, including the accuracy, completeness, reliability or suitability of the site for any particular purpose. This includes a hyperlink on or within Pureprofile products. We are not liable for any loss or damage that may result from your use of on or within Pureprofile products or any loss or damage caused by your use or reliance on any website accessed via a hyperlink on or within Pureprofile products.
17.1 We may transfer our agreement with you to someone else. We may transfer our rights and obligations under these terms to another organisation.
17.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
17.3 Nobody else has any rights under these terms. These terms and related agreements are between you and us. No other person shall have any rights to enforce any of these terms. Neither of us will need to get the agreement of any other person in order to end the agreement between you and us or make any changes to these terms.
17.4 If a court finds part of these terms illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
17.5 Even if we delay in enforcing these terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking these terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
17.6 Which laws apply to these terms and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of them in the English courts. If you live in Germany, Belgium or the Netherlands you can bring legal proceedings in respect of these terms in your own country’s or the English courts.
